Terms and Conditions — Dr. Sanjay’s
Homecare
Authorization and Consent
By availing services from Dr. Sanjay’s Homecare, the Client
authorizes Dr. Sanjay’s Homecare to provide Physician, Nursing, Physiotherapy, and
Telehealth services for consultation, evaluation, testing, and diagnosing medical conditions at
home or in a hospital setting.
The Client further authorizes Dr. Sanjay’s Homecare to administer prescribed medications as
per the directions of the primary physician. The Client acknowledges and understands the
potential risks and side effects, which have been explained by the primary physician or Dr.
Sanjay’s Homecare’s medical professionals. Dr. Sanjay’s Homecare shall not be held liable
for any untoward incidents arising from such treatments.
Medical Information Disclosure
The Client consents to Dr. Sanjay’s Homecare obtaining and disclosing medical records,
including but not limited to laboratory reports, consultation records, X-rays, hospital records,
psychiatric information, and other clinical documents, for the purpose of ensuring proper
medical care. Dr. Sanjay’s Homecare is authorized to share these records with other
healthcare providers involved in the patient’s care.
Emergency Treatment
Dr. Sanjay’s Homecare’s medical professionals are authorized to perform additional
treatments if necessary during the course of ongoing treatment. In the event of a medical
emergency, Dr. Sanjay’s Homecare is authorized to seek additional medical intervention (e.g.,
hospital or emergency room care). The Client agrees to bear all related charges for such
treatments. It is the Client’s responsibility to arrange for hospital transfer as recommended by
the primary physician or Dr. Sanjay’s Homecare physician.
Virtual Consultation / Telehealth Services
● The Client acknowledges that technical difficulties may affect telehealth sessions,
which may result in delays or interruptions.
● Telehealth consultations may be conducted via video calls; however, if technical
limitations arise (e.g., low internet speed), consultations may proceed via regular
voice communication.
● The Client consents to the storage of medical records for further evaluation and
documentation, with the assurance that all information will remain confidential.
Legal Guardian Consent
In cases where services are provided to a child, parent, or dependent relative, the undersigned
confirms they are the legal guardian and have the authority to consent to medical care.
Insurance Acknowledgment
The Client understands that Dr. Sanjay’s Homecare services may or may not be covered
under their current insurance policy and agrees to bear all expenses unless otherwise stated by
the insurer.
Amendment and Withdrawal of Consent
This consent remains in effect until withdrawn in writing by the Client. Dr. Sanjay’s
Homecare reserves the right to update these terms and conditions periodically.
Payment Terms (General Services)
● All services require advance payments as per the selected package.
● Emergency deposits may be collected for incidental expenses and will be refunded
post-contract, subject to deductions for any expenses incurred.
● The Client is responsible for additional costs such as consumables, transportation, or
medical expenses.
● Applicable taxes will be charged on all invoices.
Cancellation and Refunds (General Services)
● Services may be canceled or terminated by either party only with a minimum notice
period, which may differ as per services availed.
● Refunds will be processed within 7-10 business days subject to submission of
required documents/information.
Detailed Scope of Homecare Services
To ensure transparency and mutual understanding, the following terms apply to specific
categories of services offered by Dr. Sanjay’s Homecare:
What happens if the equipment malfunctions?
We offer 24/7 support and maintenance services to address any issues that may arise with the
equipment.
Nursing Services (Long-term & Short-term)
● Scope of Duty: Our nursing staff is trained to provide medical care, including vital
sign monitoring, medication administration, wound dressing, catheter care, and
assistance with activities of daily living (ADLs) related to the patient’s hygiene
(sponge bath, grooming).
● Exclusions: Nursing staff are strictly prohibited from performing domestic
household chores such as cooking for the family, washing clothes, sweeping/mopping
floors, or running personal errands. Their primary focus is the patient’s medical
well-being.
● Staff Welfare (For 12hr/24hr shifts): The Client agrees to provide the nursing staff
with access to a clean washroom and, in the case of 24-hour live-in care, a separate
sleeping area or mattress. The Client is requested to provide basic meals for live-in
staff or allow reasonable time for them to arrange their own food.
● Breaks: For 12-hour and 24-hour shifts, the staff is entitled to reasonable breaks for
meals and rest to ensure they remain alert and effective.
Physiotherapy Services
● Treatment Plan: The duration and frequency of physiotherapy sessions will be
determined based on an initial assessment. Progress is monitored periodically.
● Patient Cooperation: The Client acknowledges that rehabilitation is a collaborative
process. Improvement depends significantly on the patient’s cooperation and
adherence to the exercises prescribed by the physiotherapist between sessions. Dr.
Sanjay’s Homecare does not guarantee specific recovery timelines as biological
responses vary.
Physician / Doctor Home Visits
● Non-Emergency Nature: Doctor visits are scheduled for routine check-ups, chronic
disease management, and post-hospitalization follow-ups. These visits are not a
substitute for emergency response. In case of chest pain, stroke symptoms, or severe
trauma, the Client must call an ambulance immediately.
● Prescriptions: The visiting physician will provide prescriptions based on the clinical
assessment at the time of the visit. Repeat prescriptions without a physical evaluation
may be denied for patient safety.
Specialized Clinical Services Terms & Conditions
In addition to standard homecare, Dr. Sanjay’s Homecare provides specialized medical and
therapeutic services. The following specific terms apply to these categories:
Specialist Doctor Visits
(Includes Cardiologists, Orthopedicians, Pulmonologists, Neurologists, etc.)
● Consultation Scope: Specialist visits are intended for second opinions, routine
monitoring of chronic conditions, and post-hospitalization review. These visits are
clinical consultations and not emergency interventions.
● Diagnostic Limitations: The Client acknowledges that home settings lack the
advanced diagnostic infrastructure of a hospital (e.g., MRI, CT Scan, Cath Lab).
Therefore, the Specialist’s diagnosis is based on clinical examination and available
reports. If the Specialist recommends immediate hospitalization for better evaluation,
the Client must comply immediately.
● Appointment Scheduling: Specialist availability is subject to their hospital rosters.
While we attempt to accommodate preferred timings, appointments are confirmed
based on the doctor’s availability.
Rehabilitation Therapies (Occupational & Speech)
● Occupational Therapy (OT):
o Goal: OT focuses on improving Activities of Daily Living (ADLs) and fine
motor skills.
o Home Modifications: The Occupational Therapist may recommend
modifications to the home environment (e.g., installing grab bars, ramps, or
specific seating). The cost and installation of these modifications are the sole
responsibility of the Client. Dr. Sanjay’s Homecare is not liable for accidents
caused by the Client’s failure to implement safety recommendations.
● Speech and Language Therapy (ST):
o Scope: Services cover speech disorders, post-stroke communication recovery,
and swallowing difficulties (dysphagia).
o Dysphagia Disclaimer: For patients with swallowing difficulties, the therapist
will provide feeding techniques. The Client acknowledges the inherent risk of
aspiration (choking) in such patients. Dr. Sanjay’s Homecare is not liable for
aspiration pneumonia or choking incidents if the family/caregiver fails to
strictly follow the feeding protocols set by the therapist.
Audiometry at Home
● Test Environment: The Client understands that Audiometry tests require a silent
environment. While our audiologists carry portable, calibrated equipment, it is the
Client’s responsibility to provide a quiet, distraction-free room for the duration of
the test.
● Result Accuracy: Dr. Sanjay’s Homecare is not responsible for test inaccuracies
caused by ambient noise (traffic, construction, household appliances) at the Client’s
residence. If a quiet room is not available, the audiologist may recommend visiting a
clinic for a soundproof booth test.
Clinical Nutrition & Dietetics
● Diet Plans: Our Clinical Nutritionists provide personalized diet charts based on the
patient’s medical history and blood parameters.
● Adherence: The efficacy of the diet plan depends entirely on strict adherence by the
patient and family. Dr. Sanjay’s Homecare is not responsible for lack of improvement
due to non-compliance or “cheating” on the diet.
● Allergy Disclosure: The Client must disclose all food allergies and intolerances in
writing prior to the consultation. We are not liable for allergic reactions if specific
allergens were not disclosed during the intake process.
Clinical Psychology & Counseling
● Scope: Services include counseling for depression, anxiety, geriatric mental health,
and caregiver stress.
● Non-Emergency Clause: Dr. Sanjay’s Homecare does not provide services for
acute psychiatric emergencies, active suicidal ideation, or violent behavior. In such
cases, the Client must contact a psychiatric hospital or emergency helpline
immediately.
● Confidentiality: All counseling sessions are strictly confidential. However, the
Psychologist is legally mandated to breach confidentiality if there is an imminent risk
of harm to the patient or others.
Specialized Physiotherapy
(Includes Neuro-Rehab, Cardio-Pulmonary Rehab, Ortho-Rehab, and Pediatric
Physiotherapy)
● Distinction from General Physio: These sessions are conducted by therapists with
Masters-level or specific certification in their respective fields.
● Equipment: Specialized rehab often requires specific equipment (e.g., TENS
machines, weights, balance balls). The therapist may bring portable equipment, but
for long-term rehab, the Client may be advised to purchase or rent specific gear for
daily practice.
● Pain & Soreness: The Client acknowledges that specialized rehabilitation (especially
Neuro and Ortho) may involve temporary physical discomfort or muscle soreness as
part of the recovery process. This is not indicative of malpractice.
● Pediatric Care: For Pediatric Physiotherapy, a parent or legal guardian must be
present in the room for the entire duration of the session.
Cancellation & Rescheduling for Specialist Services
● 24-Hour Notice: Due to the high demand for Specialists and Therapists, any
cancellation or rescheduling request must be made at least 24 hours prior to the
scheduled visit.
● Late Cancellation Fee: Cancellations made within 4 hours of the appointment or “No
Shows” (patient not home/available) will attract a 100% cancellation fee equivalent
to the visit charge.
Service Operational Protocols & Staffing
Staff Continuity and Replacements
● Rotational Staffing: While we strive to provide the same caregiver for continuity, the
Client acknowledges that staff may change due to weekly offs, sick leave, or
resignation. Dr. Sanjay’s Homecare reserves the right to rotate staff to prevent
burnout.
● Replacement Timeline: In the event of a staff member taking sudden leave, Dr.
Sanjay’s Homecare will make every effort to provide a replacement within 12 to 24
hours. However, immediate replacement cannot be guaranteed in cases of force
majeure (heavy rains, strikes, pandemics) or remote locations.
● Direct Hiring Prohibition: The Client agrees not to directly hire or solicit Dr.
Sanjay’s Homecare staff for private employment. Doing so is a breach of contract and
may result in immediate termination of services and legal action for damages.
Code of Conduct and Safety
● Zero Tolerance for Harassment: We maintain a zero-tolerance policy regarding
physical or verbal abuse, sexual harassment, or discrimination against our staff. Any
such behavior by the Client or their family members will result in the immediate
withdrawal of services without refund, and appropriate legal action may be taken.
● Safe Environment: It is the Client’s responsibility to provide a safe working
environment. If the home environment is deemed unsafe or hazardous (e.g., structural
dangers, aggressive pets, infectious risks without PPE), we reserve the right to
suspend services.
Issues Arising from Services (Limitation of Liability)
Clinical Outcomes and Complications
● No Guarantee of Cure: Our professionals follow standard medical protocols, Dr.
Sanjay’s Homecare does not guarantee a cure or a specific outcome. The Client
accepts that the patient’s condition may deteriorate due to the natural progression of
the disease, age, or comorbidities, independent of the care provided.
● Unforeseen Complications: Dr. Sanjay’s Homecare shall not be held liable for
complications such as bedsores (pressure ulcers), falls, or hospital-acquired infections
(if the patient was recently discharged), provided that standard preventive care
measures were followed by our staff.
● Allergic Reactions: The Client is responsible for disclosing all known allergies. We
are not liable for adverse reactions to medications prescribed by the Client’s primary
physician or for reactions to standard medical supplies (like latex or adhesive tape) if
prior history was not disclosed.
Loss and Damage
● Personal Belongings: The Client is advised to secure all valuables, cash, and jewelry.
Dr. Sanjay’s Homecare conducts background checks on all staff; however, the
company shall not be held liable for any theft, loss, or misplacement of personal items
within the Client’s residence.
● Property Damage: Accidental damage to minor household items (e.g., crockery) by
staff during the course of duty is a risk borne by the Client. For significant damage
proven to be caused by gross negligence or willful misconduct of our staff, liability
will be limited to a capped amount decided by the management after an internal
investigation.
Service Interruptions
● Force Majeure: Dr. Sanjay’s Homecare is not liable for failure to provide services
due to circumstances beyond our control, including but not limited to natural
disasters, transport strikes, civil unrest, pandemics, or government lockdowns.
Dispute Resolution
● Grievance Redressal: Any complaints regarding clinical care or staff behavior must
be reported to our management within 24 hours of the incident via email or our
helpline. We are committed to investigating and resolving issues promptly.
● Jurisdiction: Any legal disputes arising out of these terms and conditions or services
provided shall be subject to the exclusive jurisdiction of the courts in the city where
the service was provided.
